TERMS OF SERVICE — LUMITYA

1. Nature of the Service

Lumitya is a digital platform that connects homeowners with independent service providers for home-related projects.

Lumitya acts solely as a digital intermediary that facilitates contact between users and independent service providers.

While Lumitya may perform basic identity verification, it does not evaluate, rank, or confirm the quality, legality, or safety of any services offered.

Users acknowledge that they are solely responsible for evaluating and selecting service providers, entering into agreements, and verifying credentials, licenses, and insurance where applicable.

You must be at least 18 years of age to use Lumitya. By accessing or using the platform, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use the platform. Users are solely responsible for ensuring they meet this age requirement.

2. No Employment or Agency Relationship

Lumitya does not employ, contract, or act as an agent, broker, or representative of any service provider.

All providers operate independently and are solely responsible for their services.

3. User Responsibilities

Users agree to:

• Conduct their own due diligence before hiring any provider
• Verify credentials, licenses, and experience where applicable
• Enter into written agreements directly with providers
• Avoid making unsecured advance payments

4. Prohibited Activities

Users must not:

• Submit fraudulent listings
• Violate intellectual property rights
• Use the platform for illegal activities
• Attempt to hack or disrupt services

5. Contractor Responsibilities

Service providers agree to:

• Provide accurate and truthful information
• Maintain valid identification (INE/CURP)
• Communicate transparently with users
• Comply with applicable laws and regulations

6. Subscription Terms

Contractor subscription fees grant access to platform visibility only. Lumitya does not guarantee the receipt of leads, client engagement, or business outcomes.

Lead distribution may vary based on location, demand, and platform activity.

7. Limitation of Liability

Lumitya is not responsible for:

• The quality, timing, legality, or safety of services
• Any agreements made between users and providers
• Any damages, disputes, or losses arising from interactions

Nothing in these Terms shall exclude or limit liability in cases where such limitation is not permitted under applicable Mexican law.

Lumitya complies with applicable consumer protection regulations under the Ley Federal de Protección al Consumidor (LFPC) and the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP), and will cooperate with PROFECO and other competent authorities when required.

8. Platform Integrity

Lumitya reserves the right to:

• Suspend or remove accounts that violate these terms
• Investigate reports of misuse or fraud
• Restrict access to maintain platform integrity

9. Dispute Handling

Lumitya is not a party to agreements between users and providers.

However, users may report issues through the platform for review and possible action on accounts.

Arbitration Agreement

Any dispute, controversy, or claim arising out of or relating to the use of Lumitya (lumitya.com), including but not limited to its services, content, or these Terms, shall be resolved exclusively through binding arbitration.

The arbitration shall be conducted in accordance with the rules of the Arbitration Center of Mexico (Centro de Arbitraje de México — CAM) or another recognized arbitration institution, as determined by Lumitya.

The seat of arbitration shall be Guadalajara, Jalisco, Mexico, and the proceedings shall be conducted in English or Spanish.

The arbitration shall be conducted by a single arbitrator. The decision of the arbitrator shall be final and binding on both parties.

Users agree to waive any right to participate in class actions, class arbitrations, or representative actions.

Notwithstanding the foregoing, Lumitya reserves the right to seek injunctive or equitable relief in competent courts to protect its intellectual property, confidential information, or prevent misuse of the platform.

10. Force Majeure

Lumitya shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, government actions, internet or communications failures, civil disturbances, or pandemic-related disruptions.

11. Modifications

Lumitya may update these Terms at any time. In the event of material changes, registered users will be notified by email at least 7 days before the changes take effect. Continued use of the platform after notification constitutes acceptance of the updated Terms.

PRIVACY NOTICE — LUMITYA

1. Data Collection

Personal data collected may include identification information (such as INE or CURP), contact details, and location data.

2. Purpose of Data Processing

Data is used to:

• Facilitate connections between users and providers
• Verify basic identity information
• Improve platform functionality and security
• We may use third-party services such as hosting, analytics, and communication tools.

3. Data Security and Retention

Data will be stored securely using industry-standard encryption and retained only for as long as necessary to fulfill the purposes described herein, or as required by law.

Data is retained for up to 24 months unless required otherwise by law.

4. Data Sharing

Lumitya may share necessary information with:

• Other users for the purpose of connection
• Service providers supporting platform operations (hosting, messaging, analytics)

5. User Rights (ARCO)

Users may exercise their ARCO rights (Access, Rectification, Cancellation, Opposition) by contacting: contact@lumitya.com

ARCO requests will be acknowledged and processed within 20 business days of receipt, in accordance with Article 32 of the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP). Lumitya may request additional information to verify the identity of the requesting party before processing.

6. Updates

This Privacy Notice may be updated periodically. Users will be notified of significant changes.

7. Responsible Party

Service Provider Agreement

1. Independent Status

The Provider is an independent contractor, not an employee of Lumitya. Lumitya does not supervise work, does not guarantee results, and is not responsible for any services provided.

2. Responsibility

Provider is fully responsible for their work, holds any required licenses or permits, is responsible for taxes and legal compliance, and will not represent themselves as employees or agents of Lumitya.

3. Platform Fees

Monthly fees are non-refundable unless required by law. Payment grants listing visibility only — not a guarantee of work, leads, or revenue. Subscription allows visibility only. Results depend on demand, location, and profile activity.

4. No Guarantee of Work

Lumitya does not guarantee leads, revenue, project value, or customer selection. Platform access does not ensure contracts.

5. Indemnification

Provider agrees to indemnify and hold Lumitya harmless from any claims, damages, lawsuits, or legal expenses arising from services performed by the Provider.

6. Reviews

Customers may leave reviews based on their experience. Lumitya may publish, remove, or moderate reviews at its sole discretion. Providers who believe a review is false, defamatory, or retaliatory may submit a written dispute to contact@lumitya.com within 15 calendar days of the review appearing. Lumitya will review the dispute and may remove or retain the review at its sole discretion. Lumitya is not obligated to mediate between users and providers over review content.

7. Termination

Lumitya may suspend, remove, or permanently ban listings at its sole discretion and without liability. Providers who are removed for cause — including fraud, misrepresentation, repeated no-shows, or abuse of platform users — may be prohibited from re-registering on the platform under the same or different identity. Lumitya reserves the right to retain relevant records to enforce this restriction in accordance with its Privacy Notice and applicable law.

8. Jurisdiction

Disputes resolved in Guadalajara, Jalisco, Mexico under Mexican law.

• Request a refund or correction if applicable
• Use Lumitya's report feature to notify us
• Consider formal legal options if necessary

Arbitration Agreement
